In Santa Marta: You order and we ship in less than 36 hours from Monday to Saturday. Rest of Colombia: You order and we ship by FedEx. For main cities the shipment takes 2 to 3 working days. For non-major cities shipping takes 2 to 5 business days.

IN THE EVENT THAT THE CONTENTS OF THESE TERMS AND CONDITIONS ARE NOT ACCEPTED IN THEIR ENTIRETY, PLEASE DO NOT PROCEED WITH THE PURCHASE OF PRODUCTS THROUGH THE PORTAL PROVIDED BY VÍVOLO SPECIALTY COLOMBIAN COFFEE. FOR THIS PURPOSE. THE USE OF THE WEBSITE IS RESTRICTED ONLY TO THOSE WHO ACCEPT THE GUIDELINES AND CONDITIONS HEREIN.

ONLY PRODUCTS THAT COMPLY WITH SANITARY PERMITS AND LICENSES ARE SOLD.

Definitions
In order to determine the meaning of the concepts used in these Terms and Conditions, we make the following definitions:
Authorization: Prior, express and informed consent given by Users to submit to these Terms and Conditions and carry out the processing of their personal data.

Products: Refers to alcoholic or non-alcoholic beverages and other non-consumable goods or "souvenirs" that are advertised through our web portal. The Products that may be advertised will be: Roasted coffee: These will be advertised jointly or individually. In the case of individually advertised units, THE product will be advertised by means of an individual reference photo, together with its unit value (VAT included) and the number of grams it contains. On the contrary, in the case of combos or "packs", the combo or "pack" will be advertised indicating the number of units it contains, the type of coffee and the individual grams of each product.

Non-consumable goods or "souvenirs": corresponds to the sale of other types of articles, such as: T-shirts, busos, caps, glasses, key rings, among others. These will be announced individually by means of reference photographs, indicating the total price (VAT included) and the sizes and/or sizes of the same.

Material: Refers to trademarks, graphic or written information of the Products, as well as their reference images. Likewise, the advertisements, news, trademarks, designs, diagrams and interactive features presented by Vívolo on the web page shall be considered Material. This Material is duly protected under the intellectual property regulations in force in Colombia and belongs to Vívolo and/or its related or associated companies only.

Means of Payment: Refers to the means of payment offered by Vívolo. to the Users of the web page. Payments may be made through all payment methods established and allowed by the payment gateway implemented (including but not limited to: credit cards, debit cards and bank debit). The "Privacy Policy", which makes a detailed reference of how we collect and store the personal information of the Users, which is requested to make a purchase through the website.

PQR's: Refers to any requests, complaints and claims submitted by Users of the website. These may be verbal or written and shall be governed by the contents of these Terms and Conditions.

Use and Access
Users, once they enter the purchase portal of the website, understand that they are governed by these Terms and Conditions for the selection and purchase of Products. The Users will be the ones who will choose of their own free will those Products to be purchased on the website and the personal information to be shared, which will be treated according to the Policy for the Treatment of Personal Data of Vívolo.

The use of the web page by the Users will be under their exclusive risk and responsibility. Likewise, the Users will only use the services offered through the web page in accordance with the applicable norms in the Republic of Colombia, the good customs and these Terms and Conditions.

Users acknowledge that Vívolo does not guarantee: That access to the web site will be permanent and uninterrupted. That use of the web site will be permanently error-free. That the service and the server(s) through which the web site operates are free of viruses and/or other agents harmful to the computer system (software or hardware) of Users' computers. Therefore, Users are responsible for taking all appropriate measures to avoid and/or correct the undesired effects of such agents external to Vívolo. In this sense, Vívolo. does not control or guarantee the absence of viruses or other elements in the contents of the web page that may cause alterations in its devices (mobile or not) and the information hosted therein.

Vívolo. may apply supplemental terms and conditions to certain activities, events or promotions for particular Products. Such supplemental terms and conditions will be communicated in conjunction with the activity, event or promotion to which it applies. Supplemental terms and conditions will be set forth in addition to and considered a part of the Terms and Conditions. Supplemental terms and conditions shall prevail over the Terms and Conditions in the event of any conflict with respect to their applicability.

Vívolo. informs Users that the promotions offered in physical stores may not coincide with the marketing of products through the website.

Vívolo. reserves the right to modify these Terms and Conditions at any time unilaterally, when it deems it appropriate, and without prior notice to Users. Such modifications will only be effective after their publication on the web page. Therefore, Users, each time they enter the website, should review the Terms and Conditions and, if they do not agree with the modifications made, they should refrain from using the services offered by the website, not making the respective purchase through this medium.

The use of the website by users after the publication of one or more modifications, constitutes the express acceptance to be bound to the Terms and Conditions in conjunction with the changes made after publication. Colo Coffee S.A.S. is not responsible for the damages that such changes may cause to uninformed users, since it is the sole responsibility of these to review the Terms and Conditions periodically to learn of potential changes that may occur.

These Terms and Conditions, any changes or modifications that may be made to them and the supplementary terms and conditions that may be developed, will always be subject to current regulations, good customs and seeking to improve the service and experience offered to Users through the website.

Hours of operation
The website will operate continuously 24 hours a day, 7 days a week. However, for the proper functioning and improvement of the website, Vívolo reserves the right to suspend the operation of the website for maintenance, updates, corrections, improvements, among others.

Suspension may be carried out unilaterally and for the time that Vívolo deems pertinent and necessary. In such events, Vívolo will inform Users when the platform is or will be subject to suspension and will not be obliged to indicate the origin, cause or duration of the suspension of the service offered through the website.

Coverage, deliveries and minimum purchase value
Coverage: The web page will allow the registration, entry and use indistinctly of any User, but its coverage for the delivery of the Products is available throughout the country with coverage of the carrier company.

Deliveries: For purchases made through the web page of the Products for delivery in the city of Bogota, the maximum delivery time will be 2 business days. For delivery in Colombia we are limited to the delivery times of the carrier that can range between 2-15 business days. The estimated delivery time will be counted from the order confirmation. This confirmation will be sent after the payment of the Product(s) to the email provided by the Users at the time of purchase.

Purchases made up to 3:00 p.m. on any business day, Saturdays, Sundays and holidays may be confirmed by Vívolo. to Users at such times and days; however, the Products will be delivered within the estimated delivery time indicated above, which will be counted as of the first business day following the purchase.

The delivery address will be the one provided by the Users at the time of purchase. Vívolo. does not promise to deliver the Products within a certain minimum time and, therefore, the time indicated is an estimate. The delivery of the Products will be subject to factors of availability of the Products, domiciliary (direct or indirect) and, likewise, to the traffic and/or weather conditions that may occur at the time when our domiciliary are making the deliveries.

Vívolo does not carry out a prior verification of the addresses provided by the Users, so in the event that a delivery address provided is outside the coverage, Vívolo will not deliver the purchased Product. If this situation arises, Vívolo may reverse the purchase made, refunding the value paid for the purchase to the User and/or requesting the User to provide an address that is within the coverage to make the delivery; in which case, if applicable, the User shall cover the additional costs generated by such new delivery.

Users, once they have created a purchase order through the Web Site, agree to be contacted by the personnel of Vívolo and/or by the external personnel designated by it, who are in charge of delivering the Products purchased through the Web Site, who will contact the telephone number and/or e-mail address provided by the Users in order to make the corresponding delivery. Vívolo will only deliver to private homes and, therefore, will not deliver to public places or places open to the public. Delivery will be made directly to the User. The User may authorize that orders be delivered to third parties. When the User authorizes third parties to receive the Products purchased through the web site, once the delivery is made by Vívolo, the User's liability shall cease, except for those rules relating to consumer rights.

The Products advertised on the website are subject to inventory availability. The User may select the Products he/she wishes in the quantities he/she prefers, which will be disclosed by Vívolo in a summary of the purchase, which will indicate (i) the total value of the Products to be purchased, (ii) any discounts, if applicable, and (iii) taxes and surcharges that may be generated, if applicable. Once this information has been disclosed, the User will be able to pay for the Products through the Payment Methods implemented in the web page.

Users shall allow the collaborators of Vívolo and/or third parties designated by it to make deliveries to contact them in order to clarify information, inform about unavailable products, confirm delivery data, inform shipping status, among others, through their email and/or through text messages (SMS) and/or through WhatsApp and/or through phone calls to the cell phone number provided at the time of making a purchase.

Minimum purchase value: Vívolo establishes a minimum purchase value through the web page, which is the sum of $ 23,000 COP (VAT included).

Shipping cost: The shipping cost shall be borne by the Users of the Website. Vívolo shall inform the Users of the value of the shipping cost of the Products purchased through the Web Site in the purchase summary. Notwithstanding the foregoing, Vívolo reserves the right to assume this value in the course of promotional activities, in which case, it will not be charged and Users will be informed in the purchase summary that the shipping value will be $ 0 COP.

Users' Rights.
Since the Products are perishable products delivered to your home and purchased through Vívolo's website and in accordance with Article 47, paragraphs 4 and 6 of Law 1480 of 2011, the right of withdrawal does not apply.

Notwithstanding the foregoing, Users may submit requests for refunds and warranty, which will be processed in accordance with the provisions of these Terms and Conditions related to the PQR's. In case of refunds, it is clarified to the Users that these processes must be subject to the terms and conditions of the intermediaries that provide the payment gateway service on the website.

Vívolo is not responsible for the processing of Users' personal data by payment gateways. Users are advised that they must review and accept the terms and conditions and personal data processing policy of the payment gateways, in order to authorize them to carry out the proper processing of their personal and financial data at the time of making the purchase of the Product through the website.

Users shall have the right to cancel orders only before making the payment through the Payment Methods implemented on the website. In case of concerns about changes and / or cancellations, Users should communicate between 8:00 a.m. to 4:00 p.m. on business days by telephone only, through the lines: 7030325.

Liability
Vívolo is not liable for any direct, indirect, consequential, incidental, special or consequential damages that Users may suffer as a result of their use of the Web site, nor for the partial or total suspension or termination of the operation of the Web site.

General
Authorization: Vívolo clarifies that Users who wish to use the web page must grant their Authorization to these Terms and Conditions and the processing of their personal data, giving their prior, express and informed consent, by selecting the appropriate box for this purpose, which states "I have read and agree with the Terms and Conditions and the Policy for the Processing of Personal Data".

Intellectual Property: All Material implemented and used on the Web Site is the property of Vívolo and its related or associated companies. Consequently, Users may not use, implement, disclose, use, copy, reproduce, modify, remove and/or develop economic exploitation of such Material. This restriction applies at all times and in all territories, involving all existing or future forms of disclosure of information (whether technology-based or not). In this sense, the use of the web page by the Users does not imply or grant any license or permission in favor of the Users for the use in any form of the Material, without the prior written consent of Vívolo.

Cookies: Users of the Website authorize and accept that Vívolo at its discretion, may implement or use a tracking system through the use of cookies. Vívolo informs that cookies are files that are installed on the hard disk of the Users, with a defined duration in time, which make it possible to personalize the searches and preferences of the Users on the website. These cookies are used in order to know the interests, behavior and demographics of those who purchase or are visitors to the website, so that Vívolo can develop systems to identify preferences and so that Users can visualize their preferred Products in a simpler and more user-friendly way and, eventually, receive promotions on such Products purchased more frequently. Vívolo states that the use of cookies will be made solely for the purpose of benefiting the User's experience on the website. In view of the foregoing, Vívolo will not use them for other purposes.

It is established that the installation, permanence and existence of cookies on the computer or mobile device, through which the User accesses the website, depends on his exclusive will and can be removed from it whenever he wishes. Vívolo will have a channel for Users to exercise their rights, submit PQR's about the content of these Terms and Conditions, the Products and their delivery. For this purpose, the User who wants to submit a PQR should contact us through any of the following means: telephone: 7030325 and/or e-mail: comercial@vivolocafe.com and Vívolo will respond within the legal terms established in the current regulations. Taking into account that the web page receives payment from Users through the platform of a third party, Vívolo may redirect the request to the entity providing the payment gateway service to resolve it.

Territoriality: Any dispute or claim arising from the use of the website shall be resolved in accordance with the laws and courts of the Republic of Colombia only.

Validity: These Terms and Conditions are effective and binding on Vívolo and the Users of the website as of the date of their publication.
